The High Anti-Corruption Court has found a lawyer from one of Kyiv’s law firms guilty of offering $200,000 to prosecutors from the Specialised Anti-Corruption Prosecutor’s Office (SAPO) and a detective from the National Anti-Corruption Bureau (NABU) in 2024. According to EP, the lawyer in question is Oleksiy Nosov, who defended Mykhailo Kipperman in the case concerning the misappropriation of electricity from Ukrenergo.

The Specialised Anti-Corruption Prosecutor’s Office announced the verdict

The High Anti-Corruption Court has handed down a sentence to a lawyer from one of the capital’s law firms, who was accused of attempting to bribe prosecutors from the Specialised Anti-Corruption Prosecutor’s Office and a detective from the National Anti-Corruption Bureau.

The court found the lawyer guilty and sentenced him to four years and six months’ imprisonment.

The convicted man was also disbarred for a period of three years.

The lawyer in question is Oleksiy Nosov. He was defending businessman Mykhailo Kipperman in a case concerning the misappropriation of electricity from Ukrenergo.

What the case was about

According to the investigation, in 2024 the lawyer offered $200,000 in bribes to prosecutors from the Specialised Anti-Corruption Prosecutor’s Office (SAPO) and a detective from the National Anti-Corruption Bureau of Ukraine (NABU).

According to the prosecution, the funds were offered in exchange for a decision to transfer the criminal proceedings concerning his client to another pre-trial investigation body.

The case concerns the misappropriation of electricity from PJSC “NPC “Ukrenergo” and the laundering of funds obtained from its sale.

The SAPO and NABU referred this case to court back in November 2024.

Connection to the “Ukrenergo” case

In 2024, NABU and the SAPO reported the exposure of a scheme to misappropriate electricity from NEC “Ukrenergo” and launder the proceeds from its sale.

According to the investigation, the losses in this case amount to over 716 million UAH.

The investigation claims that in March 2022, United Energy LLC, which at the time was one of the largest electricity traders in Ukraine, purchased electricity from NEC “Ukrenergo” worth over 716 million UAH.

Despite the company’s existing debt to “Ukrenergo”, the sale of electricity was not halted.

A commercial bank acted as the guarantor of payment. According to the investigation, the decision to issue the guarantee was taken by the bank’s chairperson alone and in breach of procedure.

The electricity was subsequently sold to actual market participants, and the proceeds were transferred to the accounts of a foreign company controlled by the organiser of the scheme.

Who is involved in the proceedings

According to the investigation, the organisers of the scheme in the “Ukrenergo” case included businessman Mykhailo Kipperman, former director of the department at NEC “Ukrenergo” Dmytro Kondrashov, and chair of the board of “Bank Alliance” Yulia Frolova.

Mykhailo Kipperman is described by the media as a business partner of Ihor Kolomoyskyi.

Separately, the SAPO and NABU investigated the actions of a lawyer who, according to the prosecution, attempted to secure the transfer of his client’s case to another pre-trial investigation body in exchange for money.

The High Anti-Corruption Court’s verdict specifically concerns the lawyer and the attempt to bribe prosecutors from the SAPO and a NABU detective.

This is not a verdict in the main case concerning the misappropriation of over 716 million hryvnias’ worth of electricity from Ukrenergo.

Further assessment of the actions of other individuals involved is to be made by the court in the relevant proceedings.
