A US court has overturned the $100,000 fee for H-1B visas introduced by Trump
This is according to Reuters.
Trump announced the ban in September 2025. At the time, the administration claimed that it was lawful because the president had the right to impose it under federal immigration law, which allows him to restrict the entry of certain foreigners when he deems it ‘detrimental to the interests of the United States’.
Despite this, following a lawsuit by the attorneys general of 20 states, the court ruled that it was not a penalty but a tax that Trump had introduced without Congress’s authorisation. The judge also noted that in February 2026, the Supreme Court struck down Trump’s sweeping tariffs, which he had imposed under a law intended for use in national emergencies.
White House spokeswoman Taylor Rogers stated that the Trump administration is confident the court will overturn the ruling.
The H-1B visa programme offers a quota of 65,000 places annually and provides an additional 20,000 for specialists with higher education for a period of three to six years. Previously, the fee ranged from $2,000 to $5,000. According to the US Citizenship and Immigration Services, as of 15 February, only 85 people had paid for Trump’s visas.
