Tishchenko will be brought before the court by force for failing to attend hearings
The Office of the Prosecutor General informed hromadske of this.
The Shevchenkivskyi District Court of Dnipro has ordered the compulsory attendance of MP Mykola Tyshchenko.
According to the prosecution, the decision was made because Tyschenko had ignored previous court hearings.
The trial against the MP is currently at the stage of examining the prosecution’s written evidence.
The case concerns the unlawful deprivation of liberty and assault of Dmytro Mazokha, a former member of the Kraken special forces unit of the Main Intelligence Directorate, in Dnipro.
As reported by the prosecution, due to his failure to attend hearings, the court had already imposed a fine of 3,328 UAH on Tishchenko. However, he continued to fail to fulfil his procedural obligations regarding attendance.
Following yet another failure to appear, the prosecutor filed a motion for his compulsory attendance. The court deemed Tishchenko’s reason for non-attendance to be invalid and granted the prosecutor’s motion.
Compulsory attendance is to be enforced against Tyschenko at the next hearing, scheduled for 14 May.
What is known about the case
Mykola Tyshchenko is accused of unlawful deprivation of liberty under Part 2 of Article 146 of the Criminal Code of Ukraine.
The case relates to a clash in the centre of Dnipro in June. At that time, a group of unidentified men in uniform attacked Dmytro Mazokha, a former member of the Kraken special forces unit with the call sign “Son”, whilst he was out walking with his child.
Telegram channels reported that he was attacked by Tyschenko’s bodyguards. Meanwhile, the MP himself claims that the soldier struck the investigator several times whilst the latter was conducting a search of a fraudulent bot farm, and then attempted to flee.
The police, reporting on the altercation, noted that unknown individuals in camouflage clothing and balaclavas had inflicted bodily harm on the 33-year-old man and unlawfully detained him. At the time, the police did not report the attack on the investigator.
Subsequently, the State Bureau of Investigation (SBI) charged Tyshchenko. According to the investigation, the soldier was unlawfully detained on his direct orders.
If Tyschenko is found guilty in court, he could face up to five years in prison.
The MP’s bodyguard, Kostyantyn Tsubera, who along with Tyshchenko is suspected of attacking the soldier, has already reached a plea deal with the investigators and agreed to testify.
The investigator who took part in the altercation in Dnipro turned out to be a police officer from Kyiv. An internal investigation was launched against him, and he was subsequently dismissed by the Kyiv police.
As reported by ThePublic, the State Bureau of Investigation (DBR) announced new charges of treason against a sitting MP.
