Iryna Zarutska was a Ukrainian refugee who left for the US after the outbreak of full-scale war.
The federal case against Decarlos Brown Jr, who is accused of fatally attacking Ukrainian refugee Iryna Zarutska on a light rail train in Charlotte, has been adjourned. The judge ruled that the suspect is currently unfit to stand trial and ordered him to be sent for treatment at a federal medical facility.

Federal Judge Kenneth Bell ruled that Brown is currently unable to understand the legal proceedings or assist his defence, but the prognosis for his recovery of mental capacity following treatment is positive.

In the US, the federal trial in the case of the murder of 23-year-old Ukrainian refugee Iryna Zarutska has been postponed.

Decarlos Brown Jr, who is accused of the attack, has been deemed unfit to stand trial at this stage.

The court ordered him to be placed in the custody of the US Attorney General for transfer to a secure federal medical facility. There, Brown is to undergo treatment for a period of up to four months.

What the court decided

Federal Judge Kenneth Bell agreed with the experts’ findings that Brown is currently unable to participate fully in the legal proceedings.

This concerns his procedural competence, not a verdict of not guilty or the dismissal of the case.

After four months of treatment, specialists are to determine whether Brown can regain the capacity to stand trial.

If he shows signs of regaining competence after that, treatment may be extended for a “reasonable period”. Should compulsory medication be required, the court must hold a separate hearing.

What is Brown accused of?

Decarlos Brown Jr is accused of the fatal attack on Iryna Zarutska on 22 August 2025.

According to the investigation, the Ukrainian woman was stabbed from behind whilst sitting in a light rail carriage in Charlotte and looking at her phone.

The federal charge relates to violence on public transport. Brown could face life imprisonment or the death penalty in this case. Separately, in the state of North Carolina, he is charged with first-degree murder.

What happened to Zarutska

Iryna Zarutska was a Ukrainian refugee who moved to the US after the outbreak of full-scale war.

She had a background in art and restoration. At the time of her death, she was working in a pizzeria and training to be a veterinary assistant.

Her death in Charlotte caused a stir in the US and sparked a political debate about public transport safety, crime and the mental health system.

What is known about the suspect’s condition

During the federal hearing, Brown interrupted the court several times and claimed that someone was allegedly “controlling his body”.

In a written statement to the court, he also claimed to be experiencing an “emergency situation with his body” and asked the court to order law enforcement to investigate this.

His relatives had previously told CNN that Brown had schizophrenia. The defence links the issue of his fitness to stand trial to his mental state.

What about the state case

In addition to the federal case, separate proceedings against Brown are ongoing in the state of North Carolina.

This case has also been postponed for at least six months after he was deemed unfit to stand trial at the state level.

State prosecutors have stated that they will wait for the federal case to conclude before resuming their proceedings.

What is important

The court’s decision does not mean that the suspect is being released.

Brown remains in custody and is to undergo treatment at a federal medical facility.

The US Attorney’s Office stated that its aim is to secure justice for Iryna Zarutska and her family. Following treatment, the court must reassess whether the defendant is fit to stand trial.
