The Verkhovna Rada has passed a law to simplify the process of confirming insurance history
This is reported on the Verkhovna Rada website.
The Rada explains that the new law will improve and simplify the mechanism for counting work experience towards insurance contributions in the absence of the necessary documents (due to the liquidation of enterprises, loss of archives, temporary occupation of Ukrainian territory, etc.) and, consequently, ensure citizens’ right to adequate pension provision.
The law aims to:
- improving the legal mechanisms for confirming insurance periods and simplifying the procedures for awarding and recalculating pensions for persons who lack the necessary documents due to the loss of archives, the liquidation of enterprises, the temporary occupation of territories, etc.;
- ensuring the realisation of citizens’ right to adequate pension provision by expanding the scope for using data from state electronic information systems and registers containing information on employment history, payment of the single contribution, wages and other details necessary for the award (recalculation) of pensions.
The law provides for:
- the obligation of the Pension Fund to inform the individual in the event that the public electronic registers lack the information necessary for the award (recalculation) of a pension, as well as regarding the procedure for confirming insurance periods, including through legal proceedings;
- the inclusion in the insurance record for determining pension entitlement of periods of employment for which insurance contributions have not been paid, provided the insured person has outstanding insurance contribution debts and has submitted reports for such periods;
- in the absence of an employment record book or relevant entries therein, the length of service is established on the basis of:
- available documents containing information on periods of employment;
- the testimony of at least two witnesses who knew the applicant through working with them, in the cases and in the manner determined by the Cabinet of Ministers of Ukraine;
- a court decision establishing the period of employment and the nature of the work performed.
