Unplaced coal: the state company won a high-profile court case
Kyiv Commercial Court sided with the state-owned "Centrenergo" and ordered a private company to pay 239.41 million UAH for an unfulfilled coal supply contract.

The Commercial Court of Kyiv has issued a ruling regarding the dispute between the state enterprise "Centrenergo" and the private company "Energо Resource Group." As reported by ThePublic.info citing court decision dated November 6, the enterprise is required to pay 239.41 million UAH due to non-fulfillment of the coal supply contract conditions.

According to case materials, in February 2024, "Centrenergo" made an advance payment of 770.74 million UAH for coal supplies. However, "Energо Resource Group" fulfilled its obligations only partially — 124 thousand tons were supplied for a total of 576.99 million UAH.

In May 2025, the state company sent a demand to return 193.75 million UAH but did not receive a response — thus, it turned to the court.

Judge Serhiy Turchin agreed with "Centrenergo" and ordered the private company to pay 239.41 million UAH, including:

  • 193.75 million UAH — advance payment;

  • 4.5 million UAH — penalty for late delivery;

  • 2.52 million UAH — inflation losses;

  • 892 thousand UAH — 3% interest;

  • 36.97 million UAH — damages for unregistered tax invoices;

  • 520 thousand UAH — inflation losses for unregistered invoices;

  • 261 thousand UAH — 3% interest for unregistered invoices.

The owner of LLC "Energо Resource Group" is Oleksiy Pruzhenco, registered in the settlement of Georgiivka, Luhansk region.
