Return of powers to NABU and SAP: what is the essence of the presidential bill
The bill abolishes procedural restrictions for the Specialized Anti-Corruption Prosecutor's Office (SAP), introduced by Law No. 4555-IX, and protects cases of the National Anti-Corruption Bureau (NABU) from interference by other bodies, obliging NABU detectives to follow the instructions and directives only from the SAP prosecutor.
The document, in particular, provides for a ban on the Attorney General requesting case materials from NABU, as well as transferring them to other agencies — except in cases where NABU objectively cannot operate. This is intended to prevent interference in high-profile anti-corruption investigations. Additionally, the bill restores the right to conduct urgent searches without a court order in cases of NABU and SAP.
Separately, the bill introduced by the president provides for a new mechanism for verifying the integrity and security of employees of all bodies with access to state secrets: NABU, SAP, BEE, DBR, National Police, Office of the Prosecutor General.
They will be regularly tested with polygraphs (at least once every two years) according to SBU methodology, as well as monitored for possible cooperation with Russia.
