Following the attacks on Wildberries, Russia’s ‘Yandex Market’ refused to accept responsibility for the consequences of the drone strikes

Specifically, the Russian ‘Yandex Market’ has amended the terms of its agreement with sellers who list goods on the platform. The company has included a list of circumstances in the ‘Force Majeure’ section where the marketplace is exempt from liability.
These include:
- any consequences of the use of weapons, military equipment or aircraft (including drones);
- strikes, civil unrest, uprisings, rallies, demonstrations or picketing;
- restrictive measures imposed by state authorities (in particular, restrictions on movement);
- terrorist acts, military operations, the imposition of martial law or a state of emergency, and other special legal regimes;
- the leakage or spread of any polluting or toxic substances;
- natural disasters.
In the previous version of the document dated 1 July, the section entitled ‘Force majeure circumstances’ did not specify exactly which circumstances were referred to.
The old version also stated that both parties were exempt from liability for failure to fulfil their obligations in the event of force majeure. However, under the new rules, only the contractor – that is, the marketplace itself – is exempt.
The obligation to immediately inform the other party of the occurrence of a force majeure event and to provide documentary evidence of it has also been removed from the contract.
Previously, two other marketplaces popular in the Russian Federation — Ozon (12 June) and Wildberries (7 July) — had amended the terms of their agreements with sellers. The companies removed their liability for failure to fulfil obligations in the event of a drone attack.
Over the past few days, Ukrainian drones have attacked the warehouses of the Russian marketplace Wildberries on two occasions. On 18 July, logistics centres in the Moscow and Tambov regions of the Russian Federation came under attack, and on 22 July, warehouses in the Krasnodar and Stavropol Krais were targeted.
In total, the Ukrainian Armed Forces have targeted around 10 per cent of the entire logistics infrastructure of Russia’s largest marketplace, Wildberries, with drone strikes, putting 8 per cent of the company’s warehouses out of action.
