Military service and return to duty: The State Bureau of Investigation has launched a simplified procedure

The SBI has introduced an internal mechanism for military personnel who are on sick leave and are ready to return to duty.
This concerns military personnel against whom proceedings may be brought under Article 407 of the Criminal Code of Ukraine – unauthorised absence from a military unit or place of service – as well as under Article 408 – desertion.
The bureau explains that the new procedure allows investigators to swiftly carry out the procedural steps necessary to prepare for the closure of criminal proceedings if the serviceman is ready to return to service.
How the SBI’s new mechanism works
According to the SBI, the procedure has been in place since May 2026.
Its aim is to help servicemen who have left their unit under duress to quickly navigate the organisational and legal stages and return to their comrades.
The bureau emphasises that the investigators’ task in this process is not to create additional problems, but to help the individual sort out the paperwork, go through the procedure required by law and return to service as quickly as possible.
How many military personnel have already applied
In the first month of the scheme’s operation, the SBI received over 1,700 applications from military personnel and their representatives.
Most applications were received via the telephone hotline, by post or via a special form on the SBI website.
The bureau noted that all applications are already at various stages of processing.
Why are servicemen afraid to return
The SBI explains that some military personnel in the Western Military District are not returning due to fear of accountability.
Others do not know where to start, or are convinced that upon their return they will face nothing but punishment and bureaucracy.
The bureau assures that this is not the case. If a soldier is ready to return to service, the state provides them with that opportunity.

Servicemen on special leave who wish to return to service may contact the territorial offices of the State Bureau of Investigation.

The DBR states that it will explain the procedure to servicemen, provide the necessary advice and assist them in completing the procedures required by law.
Why this is important
The reserve status remains one of the most pressing issues for the military during a full-scale war.
The SBI’s new mechanism effectively provides military personnel with a clear path to return: application, consultation, procedural formalities and return to service.
For the army, this is also a practical matter. The return of trained servicemen to the ranks may be more effective than lengthy criminal proceedings with no real benefit for the front line.
