The Cabinet of Ministers proposes penalties for breaches relating to veterans’ status
The bill proposes introducing a mechanism for holding officials to account.
Government Bill No. 15258 has been registered in the Verkhovna Rada; it aims to introduce liability for violations committed during the granting of statuses related to the war and the defence of Ukraine. This concerns the status of combatants, persons with war-related disabilities, war veterans, family members of deceased veterans, Defenders of Ukraine and other categories defined by law.

This was announced by Taras Melnychuk, the Cabinet of Ministers’ representative in the Verkhovna Rada.

The Cabinet of Ministers of Ukraine, as the initiator of the legislative proposal, has registered draft law No. 15258 with the Verkhovna Rada.

The full title of the document is “On Amendments to the Code of Ukraine on Administrative Offences regarding liability for breaches of requirements in the sphere of granting status in accordance with the Law of Ukraine ‘On the Status of War Veterans and Guarantees of Their Social Protection’”.

In simple terms, the government proposes to establish administrative liability for officials who breach the rules when granting statuses related to war, military service, the defence of Ukraine and the consequences of war.

The draft law also provides for liability for obstructing control measures.

Which statuses does this apply to?

The draft law concerns the granting of combatant status in accordance with the procedure set out in Article 6-1 of the Law “On the Status of War Veterans and Guarantees of Their Social Protection”.

It also covers the status of persons with war-related disabilities, war participants, persons with special merits to the Motherland, and victims of the Revolution of Dignity.

Separately, the document covers family members of fallen or deceased war veterans, as well as family members of fallen or deceased Defenders of Ukraine.

The role of the Ministry of Veterans’ Affairs

The draft law proposes designating the Ministry of Veterans’ Affairs as the sole body responsible for monitoring compliance with legislation when granting such statuses.

The Ministry for Veterans’ Affairs also seeks to be granted the power to monitor whether local authorities responsible for veterans’ policy apply the law uniformly.

In other words, the aim is to ensure that the procedure for granting statuses operates according to uniform rules, and that local authorities do not apply the law differently.

Who may be held accountable

The draft law proposes introducing a mechanism for holding officials accountable.

This applies to cases where their actions or inaction lead to the unlawful granting of status.

Liability is also provided for in cases of obstructing or hindering inspections.

In effect, the document is intended to create a legal mechanism for responding to violations in the granting of veteran status and status to family members of fallen Defenders of Ukraine.

What will change in the legislation

The draft provides for amendments to the Code of Ukraine on Administrative Offences.

Amendments are also proposed to the Law “On the Status of War Veterans and Guarantees of Their Social Protection”.

If the bill is passed, the legislation will include grounds for liability for violations during the granting of statuses defined by law and for obstructing oversight in this area.
