Ukrainian Armed Forces soldiers have been waiting for years to be transferred due to decisions made by their commanders.
This was reported by The Public with reference to RBC-Ukraine and comments by lawyer Tetiana Kozyan.
According to her, "relationship" means that another military unit is ready to accept the serviceman, but the transfer requires the approval of the commander of the unit where he is currently serving.
The lawyer noted that the commander has the right to refuse the transfer only on the grounds provided for by regulatory acts. Such a refusal must be in writing and justified. Formulations such as "inappropriate" or "I do not want to let him go" are not legal grounds.
In the event of an unjustified refusal, the serviceman may request a written explanation, appeal to the higher command or file a complaint with the military authorities. In extreme cases, it is possible to appeal to the administrative court.
According to Kozyan, the Army+ digital application allows documents to be submitted online for transfer, but has not changed the approval procedure, as the final decision remains with the command.
She also noted that transfers are mandatory if they are based on the conclusion of a military medical commission and are related to the health of the serviceman.
Transfers between different military formations, in particular between the Armed Forces and the National Guard, remain the most difficult, as they have different personnel accounting and subordination systems.
