In Zakarpattia, a man with a disability was unlawfully detained at the TCC
A resident of Zakarpattia who was entitled to a deferment from mobilisation
In the Zakarpattia region, a man with a disability, who had a legally recognised right to deferment from mobilisation, was unlawfully detained at one of the regional recruitment and social support centres

Dmytro Lubinets announced this on his Telegram channel.

What is known about the situation

According to the ombudsman, the case concerns a resident of Zakarpattia Oblast born in 1970. As stated in the complaint, police officers took him to one of the units of the Zakarpattia Regional Centre for Temporary Detention and Pre-trial Detention, where the man continued to be held, despite documents confirming his right to a deferral.

Lubinec also noted that the man suffers from tuberculosis and requires ongoing treatment and regular medication. According to the complainant, whilst at the TCC, he was not provided with adequate medical care or the opportunity to take his necessary medication on time.

Upon receiving the complaint, the Ombudsman instructed his representative in the Zakarpattia region to verify the facts set out. According to him, following a prompt response, the man was released and his right to a deferral was reinstated.

The case files were forwarded to the law enforcement authorities

Dmytro Lubinets reported that a report concerning a possible abuse of power by a military official had been sent to the Specialised Prosecutor’s Office for Defence in the Western Region. A report regarding a possible abuse of power by a law enforcement officer was also forwarded to the State Bureau of Investigations.

In addition, a request was sent to the Military Law Enforcement Service of the Armed Forces of Ukraine and the ‘West’ Operational Command to carry out an inspection and an internal investigation.

Lubinec emphasised that mobilisation in wartime is necessary, but it must take place strictly within the framework of the Constitution and the laws of Ukraine. According to him, the unlawful restriction of citizens’ rights undermines trust in state institutions.
