The director of a private company has been charged in connection with a case involving losses of 129 million hryvnias during energy tenders
According to the investigation, officials from companies in the energy sector, in collusion with representatives of a private company, organised a scheme to embezzle funds during tender-based procurement and the execution of works in the energy sector.
The investigation established that those involved in the scheme ensured that a specific private company won the tenders, after which the works and services were carried out at deliberately inflated prices. This involved emergency repair and restoration work on overhead power lines, as well as the implementation of projects to install and connect gas-piston cogeneration units.
According to law enforcement officials, after receiving payment at inflated prices, the excess funds were diverted from the legal economy via companies showing signs of being shell companies, which formed part of a so-called ‘conversion centre’. To this end, they used fictitious transactions and the bank details of controlled companies.
In particular, the investigation established that between 2022 and 2026, these business entities registered tax invoices without any actual supply of goods to a private company.
According to preliminary data, state and municipal enterprises suffered losses amounting to 129 million hryvnias.
As part of the criminal proceedings, law enforcement officers carried out a series of searches, during which they seized material evidence which, according to the investigation, confirms the illegal activity.
Under the procedural supervision of the Kyiv Regional Prosecutor’s Office, the director of the private company was served with a notice of suspicion under Part 3 of Article 209 of the Criminal Code of Ukraine, which provides for liability for the legalisation of property obtained by criminal means. The investigation is ongoing.
In accordance with Article 62 of the Constitution of Ukraine, a person is presumed innocent until proven guilty in court.
