The High Anti-Corruption Court has approved a plea agreement with the former head of the state-owned enterprise ‘Industrial Enterprises Management’ at PJSC ‘Ukrzaliznytsia’ Dmytro Rudkovskyi in the case concerning the procurement of wooden sleepers and timber.

This was reported by “Slovo i Dilo”, citing a decision by the High Anti-Corruption Court dated 2 June.

The High Anti-Corruption Court has approved a plea agreement concluded between a prosecutor from the Specialised Anti-Corruption Prosecutor’s Office (SAPO) and Dmytro Rudkovskyi, the former head of the state-owned enterprise “Industrial Enterprises Management” at PJSC “Ukrzaliznytsia”.

The case concerns the procurement of wooden sleepers and timber for the needs of “Ukrzaliznytsia” in 2014–2015.

By the court’s decision, Rudkovsky was found guilty under Part 5 of Article 191 of the Criminal Code of Ukraine. On the basis of the agreement, he was sentenced to a term of imprisonment of eight years, as agreed by the parties.

The court also deprived him of the right to hold positions involving organisational and managerial functions in public-law legal entities for a period of three years.

Separately, the High Anti-Corruption Court ordered the confiscation of part of his property – non-residential premises in a residential building with a total area of 128 square metres.

The court exempted him from serving his sentence

At the same time, the court exempted Rudkovsky from serving the main sentence, subject to a probationary period of one year.

During this period, he must periodically report to the authorised probation authority, notify them of any change of residence or employment, and not leave Ukraine without permission.

In other words, the court formally imposed an 8-year prison sentence but effectively exempted the defendant from serving this term on probation.

What is the essence of the case

Dmytro Rudkovsky and his former deputy, Vyacheslav Podlipsky, are accused in this case.

According to the investigation, in 2014–2015, during the public procurement of wooden sleepers and timber, Rudkovsky arranged for his deputy to abuse his official position.

Investigators believe that Podlipsky acted contrary to the interests of the service and favoured companies controlled by Yaroslav Zhmurko – one of the former heads of the UZ UPP.

According to law enforcement officials, this led to a loss of assets for the company amounting to 13.65 million hryvnias.

What happened previously

Previously, the “sleepers case” involving Ukrzaliznytsia was referred to the Anti-Corruption Court.

As part of these proceedings, the High Anti-Corruption Court recognised PJSC “Ukrzaliznytsia” as the aggrieved party.

The agreement with Rudkovsky does not mean the automatic conclusion of the entire case regarding the other defendants. Further proceedings concerning them are to take place separately, unless the court issues other procedural decisions.
