In Ukraine, every building without a condominium association will have a new legal entity created for it.
This was reported by The Public, citing a presentation by Natalia Kozlovska, Deputy Minister of Community and Territorial Development of Ukraine.
According to her, a new legal entity — a simple partnership of co-owners — will be automatically created for each apartment building without an OSBB and will represent the interests of its co-owners. The founders of such a partnership will be the owners of apartments and non-residential premises, and the structure itself will act on their behalf.
It is expected that this legal entity will be responsible for the building itself, auxiliary structures and the land plot underneath it. It will be responsible for managing common property, accounting for utilities for the building's needs, choosing the form of management and concluding contracts with the manager.
Kozlovska said that the bill also provides for the land plot under a multi-apartment building to be assigned to its co-owners. The land will belong to the co-owners regardless of whether an OSBB has been created and cannot be sold or used for purposes other than those for which it is intended.
In addition, the document proposes to define HOAs and new co-owners' associations as domestic consumers of utilities. This means that they will pay for electricity and gas at rates for the population, not for businesses.
The draft law also provides for the creation of a single register for the management of multi-apartment buildings and a database of the community's housing stock.
The Ministry of Community and Territorial Development of Ukraine has announced that the law "On Housing Management" is part of the housing policy reform that began after the President of Ukraine signed the law "On the Basic Principles of Housing Policy" on 12 February 2026.
