A proposal has been put forward in the Verkhovna Rada to amend the procedure for serving summonses from the TCC
This is reported by the *Judicial and Legal Gazette*, citing the author of the document, MP Georgiy Mazurashu.
The document provides for a review of the current rules, under which a citizen may be deemed to have been notified even if they have not personally received a letter from the TCC.
When will a TCC notice be deemed to have been served?
Currently, the law allows a demand to be deemed served once the postal operator has noted that it could not be delivered to the registered address or to the address provided by the person liable for military service to the Territorial Recruitment Centre. This provision has been in force since amendments adopted in 2024.
In the view of the bill’s author, this creates situations where a person may not even be aware that a document has been sent, yet is deemed to have been duly notified and may face legal liability. This is precisely why the bill proposes to change this approach. If passed, a territorial recruitment centre’s requirement will only become legally binding once it has actually been received by the addressee.
What else is proposed to be changed
The draft bill also concerns the temporary restriction of the right to drive vehicles. The author of the initiative proposes that such a restriction should not be applied, or should be lifted, in respect of persons who notify the TCC in writing of their refusal to undertake military service during mobilisation on the grounds of religious or other personal convictions, and who declare their willingness to undertake alternative (non-military) service, carrying out other tasks for the defence of the state.
It is envisaged that such a declaration may be submitted in several ways: via an administrative services centre, by registered post, or electronically — using a qualified electronic signature or a photocopy of a document bearing a handwritten signature.
At present, draft law No. 15387 has only been registered in parliament. To come into force, it must be considered by the Verkhovna Rada and receive the necessary support from MPs.
